Susan R. Snowden, Martin & Seibert’s Director of Litigation Management, General Counsel, recently authored an article that appeared in the Defense Trial Counsel of West Virginia 2015 Notebook of Articles entitled “Can Insurance Carriers Require the Use of Salvage/Recycled OEM Crash Parts When Negotiating Repairs for Motor Vehicles in West Virginia?”
Ms. Snowden, who is on the board of governors of the West Virginia Defense Trial Counsel, has previously had articles published in the Counsel’s annual notebook of pertinent legal issues which is made available to defense counsel and judges throughout the state. This particular article discusses the use of OEM parts and salvage/recycled OEM crash parts in the repair of autos in WV and the law applicable to those repairs. An analysis of the differences between Genuine Original Equipment Manufacturer (“OEM”) parts; Aftermarket parts; and Reconditioned or recycled OEM parts in of particular interest in the article. Further, the use of those parts in WV in light of the decision of the Supreme Court of Appeals of WV in the case of Liberty Mut. Ins. Co. v. Morrisey, 760 S.E.2d 863 (W. Va. 2014) is discussed by Snowden.
