The West Virginia Supreme Court of Appeals has appointed Martin & Seibert Director of Litigation E. Kay Fuller to a committee to revise the West Virginia Rules of Civil Procedure. The Court appointed six lawyers from across the State to consider necessary revisions and potential additions to the rules which governs all civil litigation in the State.
Recognizing that the rules were last revised in 1998, the Court appointed the practice-diversified committee to conduct a comprehensive review and to recommend necessary changes to bring the rules current. The Court is presently rolling out electronic filing and the rules must be revised accordingly. Likewise, all other rules of civil procedure are being studied by the select committee.
The Committee has been charged with reviewing West Virginia Supreme Court rulings, the Federal Rules of Civil Procedure, rules in other states, advances in the law and technology as well as independent research the Committee deems necessary. The Committee will present recommended rules to the Supreme Court for review before the Court releases proposed revised rules for public comment.
“The Rules of Civil Procedure provide the framework for all civil litigation in West Virginia and a thorough understanding of the rules and the reason for each rule is vital to a successful civil practice,” Fuller said. “Having some part in the development of civil litigation practice in West Virginia is a great honor.”
